Article 1 — Purpose
These terms govern the sale of digital files intended for 3D printing, offered on ixezed.com by Mourad Aoudia EI, a sole trader registered under SIRET number 99112503000015 (hereinafter “the seller”), to any natural person not acting for professional purposes (hereinafter “the customer”).
Placing an order implies unreserved acceptance of these terms, which the customer acknowledges having read before confirming the purchase.
Article 2 — Products
The products sold are digital files, in STL and 3MF formats, intended to be printed by the customer on their own equipment. No physical object is delivered.
Each product page states which wheel or wheels the part fits, the formats supplied and the recommended print settings. Those settings are given as guidance: the result depends on the printer, the filament and the settings chosen by the customer.
Article 3 — License of use
The purchase grants the customer a personal, non-exclusive and non-transferable license allowing them to print the part for their own use, in as many copies as they wish.
The following are forbidden, unless the seller gives written permission:
- sharing or redistributing the file, whether free of charge or for payment;
- reselling it, including in modified form;
- printing and selling parts made from the file for commercial purposes;
- publishing it on a 3D model sharing platform.
The license is granted for the legal term of copyright protection. Breaching it terminates it automatically.
Article 4 — Prices
Prices are stated in euros, the reference currency of the contract. VAT not applicable, article 293 B of the French General Tax Code.
Customers outside the eurozone may see prices in their local currency. This conversion is carried out automatically by the payment provider, at the exchange rate in effect at the time of the transaction. The amount charged is the amount displayed at checkout.
The customer's bank may apply its own currency conversion or international transaction fees, which are outside the seller's control.
Refunds are processed at the exchange rate in effect on the date of the refund; the amount returned in the customer's currency may therefore differ slightly from the amount originally paid.
The seller reserves the right to change prices at any time; the price that applies is the one displayed at the time of the order.
Article 5 — Ordering and payment
The order is confirmed once these terms have been accepted and payment made in full, by bank card or PayPal, through a secure solution. At no point does the seller have access to the customer's banking details. An order confirmation is sent by email.
Article 6 — Delivery
Delivery is immediate and exclusively digital. The customer receives a download link by email, and can find that link at any time in their customer account, at the address used when ordering. The link stays live with no time limit. No shipping is charged.
Article 7 — Updates
When a file is fixed or improved, the new version replaces the previous one and becomes available from the same link, at no extra cost, including for customers who bought before the update.
Article 8 — Right of withdrawal
In accordance with article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a physical medium where performance has begun after the customer's prior express agreement and express waiver of their right of withdrawal.
Before every purchase, the customer gives that agreement and expressly waives their right of withdrawal by ticking the box provided for that purpose. That box is never pre-ticked and must be ticked for each file.
Where no download has taken place, the customer has fourteen days from the order to withdraw, without having to give a reason.
Article 9 — Warranties
The seller warrants that the files conform to their description. The statutory warranties of conformity and against hidden defects apply under the conditions laid down by law.
Article 10 — Liability
The seller cannot be held liable for printing results, which depend on the customer's equipment, materials and settings, nor for the use made of the printed parts.
The parts offered are accessories. It is for the customer to check that a printed part is suitable for their use and their safety before fitting it to a powered personal mobility device. The seller cannot be held liable for damage resulting from a faulty print, an unsuitable material or incorrect fitting.
Article 11 — Personal data
The processing of personal data is described in the privacy policy.
Article 12 — Complaints, mediation and applicable law
Any complaint can be sent to contact@ixezed.com.In the event of a lasting disagreement, the customer may refer the matter free of charge to a consumer mediator. The details of the mediator covering the seller are provided on request, at the address above.
These terms are governed by French law. Failing an amicable settlement, the French courts have jurisdiction.
